So where exactly is this "Commercial Felony Streaming Act" located online for anyone to read?? I sure would like to know what the implications are before they trie me in a court of law for something I know nothing about. If someone is able to find this bill for everyone to read, it sure would be helpful please.
By the way folks, it just passed The Senate Judiciary Committee, which means it will be considered for debate on the U.S. Senate floor... it's not up for a vote now. Countries outside the U.S. are not affected by U.S. legislation.
Here is the knitty gritty changes to what appears to be the DMCA proposed...
(2) shall be imprisoned not more than 5 years,
fined in the amount set forth in this title, or both,
(A) the offense consists of 10 or more
public performances by electronic means, during
any 180-day period, of 1 or more copyrighted
9 works; and
(B)(i) the total retail value of the per11
formances, or the total economic value of such
public performances to the infringer or to the
copyright owner, would exceed $2,500; or
(ii) the total fair market value of licenses
to offer performances of those works would ex16
ceed $5,000;’’; and
(2) in subsection (f), by striking paragraph (2)
and inserting the following:
(2) the terms ‘reproduction’, ‘distribution’,
and ‘public performance’ refer to the exclusive rights
of a copyright owner under clauses (1), (3), (4), and
(6), respectively of section 106 (relating to exclusive
rights in copyrighted works), as limited by sections

2 Section 506(a) of title 17, United States Code, is amend3

By the way, after reading this through...
The legislation is written so that distribution is also referred to with exclusive rights for artists... meaning because the artists have exclusive rights to their music (like rights of copyright in its entirety, including distribution through electronic means...) no matter if it is on a digital medium or not. This is meant to extend current copyright law into digital mediums specifically.
However, this would mean sites hosting links to content submitted by other users would still be protected in article 512 if they weren't making money and the other two reasons listed in 512. People actually hosting the files would pretty much officially be holding stolen product and anyone distributing content internally and / or making a profit from it would be liable for damages...
again, I am no lawyer but this is what I am understanding from the reading of the bill.
